1. Agreement to Terms

Welcome to ReturnRun. These Terms of Service ("Terms") govern your access to and use of the ReturnRun package return pickup service, website, and mobile application (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Service Description

ReturnRun provides a package return pickup service in Southern and Northern Utah. Our Service allows you to schedule a pickup for your return packages. We will collect your packages from your location and deliver them to the appropriate shipping carrier on your behalf.

3. Eligibility

By using our Service, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into binding contracts
  • You are located in our service area (Southern and Northern Utah)
  • You will comply with these Terms and all applicable local, state, and federal laws

4. User Accounts

You may need to create an account to use certain features of our Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account and to update your information as necessary.

We reserve the right to disable your account if we determine, in our sole discretion, that you have violated these Terms or that your account poses a security risk.

5. Package Requirements

You agree to comply with the following package requirements:

  • Packages must be properly sealed and ready for shipment
  • You must either provide a valid return shipping label or QR code, or indicate that you will provide one at pickup
  • Packages must not contain prohibited items, including but not limited to: hazardous materials, illegal substances, firearms, or perishable goods
  • Packages must not exceed our size and weight limitations (as specified on our website)

We reserve the right to refuse pickup of any package that does not comply with these requirements.

6. Payment Terms

By using our Service, you agree to pay all fees and charges associated with your order. We use Stripe as our payment processor. When you schedule a pickup, we will authorize your payment method for the full amount. The payment will be captured only after your package has been successfully returned to the post office.

Our fees are as follows:

  • Base pickup fee: $7.50 per order
  • Additional fee for orders with more than three packages: $3.00
  • Other fees may apply as described on our website

All fees are non-refundable except as expressly provided in these Terms or as required by applicable law.

7. Cancellation and Rescheduling

You may cancel or reschedule your pickup through your account or by contacting our customer service. Cancellations made less than 2 hours before the scheduled pickup time may be subject to a cancellation fee.

8. Service Availability and Timeliness

We offer our Service in Southern and Northern Utah. Pickup times are subject to our operating hours and courier availability. While we strive to pick up your packages at the scheduled time, delays may occur due to circumstances beyond our control, such as traffic, weather conditions, or high demand.

We are not responsible for any consequences resulting from delays in pickup or delivery to the shipping carrier.

9. Limitation of Liability

To the maximum extent permitted by law, ReturnRun, our directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) our Service
  • Any conduct or content of any third party on our Service
  • Any content obtained from our Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Damage to or loss of your package after it has been picked up by our courier

Our liability for any damages arising out of or in connection with these Terms or the Service shall be limited to the amount you paid for the specific pickup service that gave rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless ReturnRun, our directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your use of the Service
  • Your violation of any rights of a third party
  • Your package contents or shipping labels

11. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of ReturnRun and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ReturnRun.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in Utah, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You also agree to waive your right to a jury trial.

16. Entire Agreement

These Terms constitute the entire agreement between you and ReturnRun regarding our Service and supersede any prior agreements we might have had between us regarding the Service.
